Introduction to the Terms of Use and Privacy Agreement

Article 1: Introduction and Definitions

The introduction above forms an integral part of this Agreement. The following terms and expressions shall have the meanings assigned to them below:

1. The Store: This term includes all forms through which the Store operates, including an electronic application, an online website, or a physical retail location.
2. The Consumer: Any person who engages in electronic commerce for the purpose of obtaining products or services offered by the Store through its electronic platform.
3. The Agreement: These Terms and Conditions, which govern and regulate the relationship between the parties to this Agreement.

Article 2: Legal Capacity of the Consumer

1. The Consumer confirms that they have the legal capacity required under Islamic law and the applicable regulations to deal with the Store, or that they are at least eighteen years of age.
2. The Consumer agrees that, in the event of a breach of this Article, they shall bear all resulting consequences and liabilities toward third parties.

Article 3: Nature of the Store’s Obligations

1. The Store’s obligation toward Consumers is to provide the requested product or service.
2. The Store may provide additional services, including after-sales services or other related services, depending on the nature and type of the product or service requested by the Consumer.

Article 4: Conditions of Use

1. The Consumer shall use the Store’s electronic platform in a manner consistent with public morals and the applicable laws and regulations of the Kingdom of Saudi Arabia.
2. When purchasing a product or service from the Store, the Consumer shall not use such product or service in any way that violates public morals or the applicable laws and regulations of the Kingdom of Saudi Arabia.

Article 5: Accounts and Registration Obligations

When applying for membership in the Store as a user, you are required to provide certain information and select a username and a confidential password to access the Store’s services. By registering, you agree to the following:

1. You are responsible for maintaining the confidentiality of your account information and password. You must immediately notify the Store of any unauthorized use of your account information or any other breach of your confidential information.
2. Under no circumstances shall the Store be liable for any direct or indirect financial, material, or moral loss resulting from the disclosure of the Consumer’s username or password.
3. You shall personally use your account or membership with the Store and remain fully responsible for it. If another person uses your account, this shall be considered evidence that you authorized that person to use the Store in your name and on your behalf.
4. You shall use the Store seriously, honestly, and in good faith.
5. You shall provide true, accurate, current, complete, and lawful information about yourself as required during registration. You shall also update your information whenever it changes or whenever an update is required.
6. The Store is committed to treating your personal information and contact details with complete confidentiality.
7. If the Store determines that you have provided false, inaccurate, outdated, incomplete, unlawful, or otherwise non-compliant information, the Store shall have the right to suspend, freeze, or cancel your membership, Store access, or account on the platform. This shall be without prejudice to the Store’s other rights and lawful means of recovering its rights and protecting other Consumers.
8. In the event of failure to comply with any of the above provisions, the Store’s management shall have the right to suspend or cancel your account or membership, or prevent you from accessing the Store’s services again.

Article 6: Electronic Communications and Official Communication Channels

1. The parties agree that communications shall be conducted through the email address registered on the platform.
2. The Consumer agrees that all agreements, notices, statements, and other communications provided electronically shall have the same legal effect as their written equivalents and shall satisfy applicable legal and regulatory requirements.
3. The Consumer agrees that the Store may contact them and notify them of any provisions relating to this Agreement or their dealings with the Store through general messages sent to all Consumers or through messages directed to specific Store users.

Article 7: Amendments to the Terms of Use and Fees

1. If any Article or provision of this Agreement is cancelled, invalidated, or becomes unenforceable, this shall not affect the validity of the remaining Articles, provisions, rules, and conditions, which shall remain effective until further notice from the Store’s management.
2. This Agreement, as amended from time to time when necessary, constitutes the operating framework, understanding, and agreement between the Consumer and the Store.
3. The Store may impose fees on certain Consumers depending on the offers, products, or services requested, or on any fees or taxes imposed by the government in relation to the nature of the product or service.
4. The Store reserves the right to add, increase, reduce, or deduct any fees or expenses under the provisions of this Agreement for any Consumer, regardless of the reason for their registration.

Article 8: Payment and Settlement Services

1. The Store provides payment and settlement services through its partners. Payments may be completed entirely online through the payment options available on the Store or through any other payment method introduced by the Store from time to time.
2. The Store shall determine the price of each product or service offered in accordance with generally recognized market value.
3. The Store shall provide invoices, payment receipts, and collection documents for all amounts and revenues generated through the Store. The Consumer shall receive an invoice for each purchased product or service.
4. The Store shall apply generally accepted accounting standards in its electronic operations in accordance with this Agreement and in consideration of applicable legal, economic, commercial, and regulatory requirements.

Article 9: Intellectual Property

1. All intellectual property rights relating to the Store are fully owned by the Store, whether such rights existed before or arose after the establishment of this electronic platform.
2. The Consumer shall respect the Store’s intellectual property rights, including the Store’s name, words, trademarks, logos, symbols, and any other materials displayed on the Store. All rights associated with the Store’s name are the exclusive intellectual property of the Store.

Article 10: Store Liability

1. The Store shall conduct its commercial activities through this electronic platform lawfully and in accordance with the applicable laws and regulations of the Kingdom of Saudi Arabia and the provisions of this Agreement.
2. The Store shall not be liable for claims arising from errors, omissions, or negligence, whether direct, indirect, incidental, or caused by the Consumer or a third party, including shipping and delivery companies.
3. [Store Name], its employees, owners, and representatives shall ensure that the product or service is lawful, authorized, and compliant with the laws and regulations of the Kingdom of Saudi Arabia, and that it is used for lawful purposes.

Article 11: Restriction of Access or Membership

The Store may suspend or cancel the Consumer’s membership or restrict the Consumer’s access to the platform’s services at any time, without prior notice, and for any reason.

Article 12: Governing Law

This Terms of Use Agreement is governed by and construed in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia. It is fully subject to the jurisdiction and applicable regulations of the competent authorities in the Kingdom of Saudi Arabia.

Article 13: General Provisions

If any Article or provision of this Terms of Use Agreement is cancelled, invalidated, or becomes unenforceable, this shall not affect the validity of the remaining Articles, provisions, and conditions, which shall remain in effect until further notice from the Store’s management.

This Terms of Use Agreement, as amended from time to time when necessary, constitutes the complete operating framework, understanding, agreement, and contractual relationship between the Store and the Consumer.

Both parties agree to take the following into consideration:

1. The Arabic language shall be the governing language for interpreting the provisions of this Agreement or any translation thereof into another language.
2. All prices displayed for the Store’s products or services may be amended from time to time.
3. Any promotional or marketing offers introduced by the Store are temporary. The Store reserves the right to modify, suspend, or terminate such offers at any time.
4. The parties shall conduct their dealings in a manner that does not violate Islamic principles or the applicable laws and regulations governing the relationship between the Store and the Consumer.
5. This Terms of Use Agreement may only be terminated by a decision issued by the Store’s management.
