Introduction to the Terms of Use

Welcome to the White Hills online store.

The following terms and conditions govern your use of this Store and all legal consequences arising from your use of its services through this electronic platform.

Any person who uses the Store, whether as a consumer purchasing a product or service or for any other purpose, shall be deemed to have fully accepted and agreed to all provisions of these Terms of Use, provided that such person has the legal capacity required under applicable Sharia principles, laws, and regulations.

By using the Store, you confirm your commitment to comply with these Terms and all provisions stated herein. These Terms apply to all transactions and interactions between the Consumer and the Store.

These Terms shall become effective and legally binding once you accept them and begin registering with or using the Store, in accordance with Article 10 of the Saudi Electronic Transactions Law.


Article 1: Introduction and Definitions

The introduction above forms an integral part of these Terms. The following definitions apply to the principal terms used herein:

  1. Store: Refers to all forms through which the Store operates, including an electronic application, a website, an online platform, or a physical commercial establishment.
  2. Consumer: Any person who engages in electronic commerce for the purpose of obtaining products or services offered by the Store through its electronic platform.
  3. Terms: These Terms of Use, which govern and regulate the relationship between the parties.

Article 2: Legal Capacity of the Consumer

  1. The Consumer confirms that they possess the legal capacity required under applicable Sharia principles, laws, and regulations to transact with the Store, or that they are at least 18 years of age.
  2. If the Consumer violates this Article, the Consumer shall bear all consequences arising from such violation in relation to third parties.

Article 3: Nature of the Store’s Obligations

  1. The Store’s primary obligation toward Consumers is to provide the requested product or service.
  2. The Store may provide additional services, including after-sales services or other related services, depending on the nature and type of the product or service requested by the Consumer.

Article 4: Rules Governing Use

  1. The Consumer shall use the Store’s electronic platform in a manner consistent with public morals and the laws and regulations applicable in the Kingdom of Saudi Arabia.
  2. When purchasing a product or service from the Store, the Consumer shall not use it for any purpose that violates public morals or the applicable laws and regulations of the Kingdom of Saudi Arabia.

Article 5: Accounts and Registration Obligations

When applying to register as a user of the Store, you may be required to provide certain information and select a username and confidential password to access the Store’s services.

By registering, you agree to the following:

  1. You are responsible for maintaining the confidentiality of your account information and password. You must immediately notify the Store of any unauthorized use of your account or any other breach of your confidential information.
  2. The Store shall not be liable for any direct or indirect financial, material, or non-material loss resulting from the disclosure of your username, password, or account information.
  3. You shall personally use your Store account or membership and shall remain fully responsible for all activities conducted through it. If another person uses your account, this may be treated as evidence that you authorized that person to use the Store on your behalf.
  4. You shall use the Store seriously, lawfully, and in good faith.
  5. You shall provide true, accurate, current, complete, and lawful information during registration and shall update such information whenever it changes or when an update is required.
  6. The Store shall treat your personal information and contact details with appropriate confidentiality.
  7. If the Store determines that you have provided false, inaccurate, outdated, incomplete, unlawful, or otherwise non-compliant information, the Store may suspend, freeze, or terminate your membership or account without prejudice to any other lawful rights or remedies available to the Store.
  8. Failure to comply with any of the above requirements may result in the suspension or termination of your account or restriction of your access to the Store’s services.

Article 6: Electronic Communications and Official Communication Channels

  1. The parties agree that official communications may be conducted through the email address registered on the platform.
  2. The Consumer agrees that all agreements, notices, statements, and other communications provided electronically shall have the same legal effect as written communications and may satisfy applicable legal and regulatory requirements.
  3. The Consumer agrees that the Store may communicate with them and notify them of matters relating to these Terms or their transactions by sending general messages to all Consumers or specific messages to selected users.

Article 7: Amendments to the Terms of Use and Fees

  1. If any provision or clause of these Terms is cancelled, invalidated, or becomes unenforceable, this shall not affect the validity or enforceability of the remaining provisions, which shall continue in effect until further notice from the Store.
  2. These Terms, as amended from time to time when necessary, constitute the operating framework, understanding, and agreement between the Consumer and the Store.
  3. The Store may impose certain fees depending on the offers, products, or services requested by the Consumer, or any charges or taxes imposed by the relevant authorities based on the nature of the product or service.
  4. The Store reserves the right to add, increase, reduce, waive, or discount any fees or expenses in accordance with these Terms and applicable laws.

Article 8: Payment and Settlement Services

  1. The Store provides payment and settlement services through its payment partners. Payments may be completed entirely online using the payment methods available on the Store or any other payment method introduced from time to time.
  2. The Store shall determine the price of each product or service in accordance with applicable market values and commercial considerations.
  3. The Store shall provide invoices, payment receipts, and relevant transaction records for amounts arising from purchases made through the Store. The Consumer shall receive an invoice for the purchased product or service.
  4. The Store shall comply with generally accepted accounting and invoicing requirements applicable to electronic commerce, in accordance with these Terms and the relevant legal, economic, commercial, and regulatory requirements.

Article 9: Intellectual Property

  1. All intellectual property rights relating to the Store are fully owned by the Store, whether such rights existed before or arose after the establishment of the electronic platform.
  2. The Consumer shall respect all intellectual property rights belonging to the Store, including the Store’s name, trademarks, wording, logos, designs, symbols, content, and other materials displayed through the Store.
  3. No Store content may be copied, reproduced, modified, published, distributed, or commercially used without prior written authorization from the Store.

Article 10: Liability of the Store

  1. The Store shall conduct its commercial activities through this electronic platform lawfully and in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and the provisions of these Terms.
  2. The Store shall not be liable for claims arising from errors, negligence, or events caused directly or indirectly by the Consumer or by third parties, including shipping and delivery companies, except where liability may not legally be excluded.
  3. White Hills, its employees, owners, and authorized representatives shall ensure that the products and services offered through the Store are lawful and permitted under the laws and regulations of the Kingdom of Saudi Arabia and are intended for lawful purposes.

Article 11: Restriction of Access or Membership

The Store may suspend or terminate a Consumer’s membership or restrict access to the platform’s services where the Consumer violates these Terms, applicable laws, or the rights of the Store or other users.

Such action may be taken without prior notice where reasonably necessary to protect the Store, its Consumers, or its electronic systems.


Article 12: Applicable Law

These Terms of Use shall be governed by and interpreted in accordance with the laws, regulations, and legislation applicable in the Kingdom of Saudi Arabia.

Any matter relating to these Terms shall be subject to the jurisdiction of the competent authorities and courts in the Kingdom of Saudi Arabia.


Article 13: General Provisions

If any provision or clause of these Terms is cancelled, declared invalid, or becomes unenforceable, this shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

These Terms, which may be amended from time to time when necessary, constitute the agreement, operating framework, understanding, and contractual relationship between the Store and the Consumer.

The parties further agree to the following:

  1. Arabic shall be the governing language for interpreting these Terms. Where these Terms are translated into another language, the Arabic version shall prevail in the event of any conflict or inconsistency.
  2. Prices displayed for the Store’s products or services may be amended from time to time.
  3. Promotional or marketing offers provided by the Store are temporary. The Store may amend, suspend, or terminate such offers at any time, subject to applicable laws and any commitments already made to Consumers.
  4. The parties shall conduct their dealings in accordance with applicable Sharia principles and the laws and regulations governing the relationship between the Store and the Consumer.
  5. These Terms shall remain in effect unless amended or terminated by the Store in accordance with applicable laws.
